The 2026 Agriculture Appropriations Act, passed in November 2025, includes provisions that will significantly change the federal legal status of cannabis seeds sold in the United States. Effective November 12, 2026, the law will redefine certain cannabis seeds by excluding them from the definition of hemp established under the 2018 Farm Bill.

Specifically, Section 781, Exclusion C of the Act removes from the hemp definition any viable seed derived from a Cannabis sativa L. plant containing more than 0.3% THC. As a result, cannabis seeds sourced from plants exceeding this threshold will no longer qualify as hemp under federal law, regardless of the fact that the seeds themselves contain 0% THC.

This change is expected to have major implications for the cannabis seed industry, including the loss of federal protections that currently allow the interstate sale of many cannabis seeds.

At Attitude Seedbanks USA, we have been actively working behind the scenes to advocate for reasonable amendments to this legislation before it takes effect in November 2026. We have joined forces with fellow seed banks, breeders, industry leaders, attorneys, and policymakers to educate lawmakers on the unintended consequences of this provision and to pursue practical solutions that preserve access to cannabis genetics while maintaining regulatory clarity.
