"This is in response to your email of November 18, 2021 in which you request the control status of Cannabis Sativa L. seeds, tissue culture, and any other genetic material of Cannabis Sativa L. under the Controlled Substances Act (CSA). You state that the seeds, tissue culture, and other genetic material have delta-9 tetrahydrocannabinol concentrations of not more than 0.3% on a dry weight basis. The Drug Enforcement Administration (DEA) conducted a review of the CSA and its implementing regulations with regard to this question. Title 21 of the United States Code (U.S.C.) § 802(16) states that the term "marihuana" means all parts of the plant Cannabis sativa L., whether growing or not; the seeds thereof; the resin extracted from any part of such plant; and every compound, manufacture, salt, derivative, mixture, or preparation of the plant, its seeds or resin. Such term does not include the mature stalks of such plant, fiber produced from such stalks, oil or cake made from the seeds of such plant, and any compound, manufacture, salt, derivative, mixture, or preparation of such mature stalks (except the resin extracted therefrom), fiber, oil, or cake, or the sterilized seed of such plant which is incapable of germination." The CSA excludes from that definition "hemp." 21 U.S.C. § 802(16)(B)(i). The term "hemp" is "the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9-tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis." 7 U.S.C. § 1639o. Accordingly, marihuana seed that has a delta-9-tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis meets the definition of "hemp" and thus is not controlled under the CSA. Conversely, marihuana seed having a delta-9-tetrahydrocannabinol concentration more than 0.3 percent on a dry weight basis is controlled in schedule I under the CSA as marihuana. Likewise, other material that is derived or extracted from the cannabis plant such as tissue culture and any other genetic material that has a delta-9-tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis meets the definition of "hemp" and thus is not controlled under the CSA. Conversely, tissue culture and any other genetic material derived or extracted from the cannabis plant having a delta-9-tetrahydrocannabinol concentration more than 0.3 percent on a dry weight basis is controlled in schedule I under the CSA as marihuana."

These Terms and Conditions ("Terms") are applicable to any use of the store on the website www.ATTITUDESEEDBANKUSA.com (The Website), as well as any services available on the Website and to any and all offers, orders and agreements connected therewith Attitude Seed Bank USA ("The Company"), Parent Company and any DBAs'. If you do not agree with these General Terms, you may not order any products on The Website or in any other way use The Website.
General Terms
1. You must be at least 21 years old to order from The Website.
2. You agree that the use of The Website is at your sole risk.
3. The Company cannot be held responsible for the actions of persons who purchase its Novelty Collectible Genetic Souvenirs ("Hemp Souvenirs"). The Attitude Seed Bank USA does not recommend or encourage anyone to break the laws in their City, State, or Country.

By ordering you confirm that you checked your Local, State, County, and international law and it is safe for you to buy and receive Novelty Collectible Genetic Souvenirs ("Hemp Souvenirs") and that the responsibility for that decision rests solely upon YOU, the purchaser/customer. As The Company's customer, you are prohibited from distributing seeds bought from The Company to Countries, States, Cities, and/or Counties where possession of and/or trafficking of Novelty Collectible Genetic Souvenirs ("Hemp Souvenirs") is illegal.
5. We cannot and will not discuss germination/yields/THC levels (etc.) of Novelty Collectible Genetic Souvenirs ("Hemp Souvenirs"), as sold all Novelty Collectible Genetic Souvenirs ("Hemp Souvenirs") CONTAINS LESS THAN 0.001% THC. Unfortunately, emails may be ignored and remain unanswered if questions relate to the above and you may be refused a sale should you persist in requesting further information.
6. The Company reserves the right to restrict access to or sale of certain products depending on the delivery destination.

b) Help fraud prevention i.e., we reserve the right to check card details with our payment system and the right to refuse orders on that basis.
c) Open and run your account
We will never collect sensitive information about you without your agreement.
9. You must ensure to provide true, accurate, current, and complete information about yourself. You are prohibited to create an account using the name or email address of another person or company. You are fully liable and responsible for all activities that occur within your Account. You agree to notify The Company immediately of any unauthorized use of your Account or any other breach of security. The Company cannot be held responsible for any loss or damage arising from your failure to comply with these terms. It is your sole responsibility to make sure all your details are correct and current.

* By mailing a completed printable order form or your order number and payment (cash/USPS money order)
Price, Availability and Promotional Items
11. The prices on our website do not include any Sales Tax that may be due. (Depending on your shipping address) If any sales tax is due, it will be added to the final bill amount at the end of the transaction.
12. We always try to make sure that all prices on our website are accurate, but errors may occur. We will inform you as soon as possible using the contact details you have provided if we discover any error in the pricing of the products you have purchased. You will then have an option to cancel the order or reconfirm your order at the correct price. If we are unable to reach you or you do not get back to us in 10 business days, we will cancel your order.
13. We try to keep our inventory up to date but we cannot guarantee that any specific product will always be available. Should we run out of a product, and we cannot complete your order, we will contact you straight away, either by email or by telephone. If you cannot wait for your items to arrive, you can choose an alternative to replace the out-of-stock product, to the same value or more, (this may require an additional payment over the phone) so your order is shipped immediately and is not delayed any further. If there is no over product that you would like to exchange it for, we will offer you a refund on the out-of-stock item.
14. Please make sure all promotional items your order qualifies for are in the shopping cart before checking out. Please contact us if there is any issue.
15. Please be aware that the freebies and/or promotional items may change due to stock availability. We will try to keep these the same or as close to the original item as possible, but sometimes this is out of our control. However, we will substitute all.
16. We may remove any promotional item and/or UFO with no given notice.
17. ALL SALES ARE FINAL. We cannot make any changes to an order once payment has been applied, and we do not offer refunds, nor do we accept exchanges.
